Accessing Idaho Court Records
Court records consist of all the credentials and notations attached to a particular case. In Idaho, it is the state judiciary that maintains the court records. The records are maintained both digitally and physically. To get your record in Idaho, you will need to visit a courthouse in person. The Internet may help you if it is Ok for you to just take a look at the case events, without actually going through the detailed documents.
General Information on Idaho Court Records
If the custodian or person in charge of providing the Idaho court record does not deliver it to you, you can apply to the judge of the custodian. The judge will then take a decision if at all you are eligible to access the record or not. However, be prepared to wait because it takes some time for the court to confirm the decision. If you are not happy with the judge’s decision, you can file a case in the District court for receiving your Idaho court record.
How to Access Idaho Court Record?
You need to know the year when the case began, its number as well as the county. You can then go to the Clerk's office at the court. The Clerk's office is usually located within the courthouse premises. Give the Clerk the case number, and place your request for a copy of the record.
Fees
There is of course a fee involved; you can make payment by cutting a check or by sending a money order to the Idaho Vital Statistics dept. when placing an order for the certificate. You can request the certificate through fax, as well. However, there is some extra payment here as the special handling fee here.
To verify the present fees, it is essential to go to the website or call up. As a claimant, you should provide a copy of your driving license or your photo ID. In case you don't have it, then you must show 2 separate identification forms together with your signature.
Restrictions
Certain documents are kept confidential. The documents that are restricted are employment files, papers related to adoption, records of adoption, medical records, and juvenile records.
Do also remember that you will be able to access the court records only for viewing. You cannot use it for any business interest – for example you cannot sell it to anyone. If you are found guilty, then you can be punished.
Time Required
It is only on request that the custodian of Idaho's public records will provide an official copy of the court record. It generally takes about three days for the custodian to process your request. However, if the office feels that it might take longer, then the department has to inform you about this, and the document must be delivered within the estimated time.
Reason Why Your Request May Be Denied
If a record does not exist, if the application was vague or unclear, or if you hadn't applied to the right office, then your request can be denied. It will also be denied if you do not qualify to receive it.
