Accessing Indiana Court Records
The state of Indiana has a rather complex trial court system. It consists of four types of courts - they are Superior courts, Circuit courts, County courts, and City courts. The jurisdiction of these courts depends on whether a particular type of court exists in that county or not. Since there are so many courts out there in Indiana, you must know precisely which one to approach to get your court record. If you are approaching the wrong court, you cannot get the record, even though the information is in the public domain, and even if you are qualified to receive it. So it is essential that you remember this before accessing any record.
Information on the Records You Will Find in Various Courts of Indiana
- Marion County's Small Claims court contains information about the cases related to small claims up to a maximum of $6,000.
- The records maintained at the Town court give you information on the cases of misdemeanor, on domestic violence, DWI, and on traffic violations.
- The records at the City court provide Tort case information. The contract limit here is $3,000. You will also find information on DWI, domestic violence and misdemeanor.
- The County courts also maintain records of Tort cases and on the real estate. The upper limit here is $10,000. You will find records of domestic violence, felony, and DWI.
- At the Circuit courts, you will get information on contract, Tort, property rights, civil claims, issues of mental health and Tort. The records include information on misdemeanor, felony, as well as criminal appeals.

Accessing Indiana Court Records
According to the law of the country, it is the state court's responsibility to maintain the court records, and devise a mechanism so that the record can be retrieved. The Right to Information Act guarantees you the right to access these records. But there are certain restrictions though. Anyone who is not a US citizen will not get the record, and you must also be a resident of Indiana, as well. There are other requirements too.
You should be able to give an acceptable argument on why the record should be given to you, and must state the purpose of wanting to access it. You should inform the court what your relationship is with the people in the record, and/or the litigation about which you want the information. You can get the record only if the court is satisfied.

Indiana court records can be obtained through the Indiana Judicial System and through a third party site. Keep in mind that information online is a copy of the official record and may not be up-to-date.
Court Record Access Limitations
Not all Indiana court records are available online. Some public records are available for free, but you may have to pay a fee in order to access all of the court records that you need.
