In the state of Delaware it is the Superior Court that holds jurisdiction over all felony criminal court cases and nearly all drug-related offenses. The Court of Common Pleas handles nearly all criminal misdemeanor court cases with the sole exceptions of drug related offenses and traffic infractions and offenses. Criminal records in Delaware are therefore a part of these two separate court entities and access to records may be likewise split.
Delaware criminal records relating to criminal background checks are available through the Delaware State Police, while general criminal records in Delaware - at least those that are publically accessible - may be viewed by contacting the clerk of the appropriate court.
Because the state of Delaware is not an open records state, criminal records in Delaware are for the most part not available to the public except for the victims of court-tried criminal cases. Access to these records must be gained by going through the appropriate court clerk's office.
