It is a little more difficult to acquire the criminal records in Utah for someone you are hiring or want to investigate. The laws are very strict regarding the release of Utah criminal records. Utah Law 53-10-108 describes the agencies and individuals allowed access to the criminal records in Utah. Unless you are some type of government agency, medical or daycare facility, or are in the security field, it is almost impossible to get a viewing of the criminal records. An individual can request his or her own criminal history on your behalf as their employer; but only if they are willing to.

If you are an entity that qualifies to request criminal records in Utah, you must obtain a signed waiver from the person who is being investigated. The waiver must state who will see the information and how it will be used. Any use of the information other than what is agreed upon is subject to civil liability.
