The Office of Vital Statistics was formed in compliance with the Vital Statistics Act, and is addressed in Nebraska state codes 71-603, 71-649. The statute pertaining specifically to birth and death certificates is 71-608.01, and the statute pertaining specifically to marriage is 71-601.01.
Nebraska's Vital Statistics Office has been keeping records for births and deaths in the state since 1904. Marriage and divorce records begin in 1909. Because of the high risk of identity theft, those requesting access to birth records must prove they have a proper purpose for doing so. Only records filed more than fifty years ago can be requested for use as genealogy records.
Nebraska has a separate set of rules and regulations concerning the use of vital statistics records for genealogical purposes. This set of rules is available at the Nebraska Department of Health and Human Services Website. The publication is Title 174- Vital Records and it addresses specifically the use of birth, death and marriage records as Nebraska genealogy records.
