All Delaware public records are available for disclosure under their Freedom of Information Act (Title 29, Del. C. Chapter 100). Pursuant to Delaware Public Records Law, public records in Delaware are defined as ?any document, book, photographic image, electronic data recording, paper, sound recording or other material regardless of physical form or characteristics, including electronic records created or maintained in electronic information systems, made, used, produced, composed, drafted or otherwise compiled or collected or received in connection with the transaction of public business or in any way related to public purposes by any officer or employee of this State or any political subdivision thereof." Also included in this definition are ?electronic records."
The FOIA acts states that access to public records in Delaware should be available to everyone. "It is vital in a democratic society that public business be performed in an open and public manner so that our citizens shall have the opportunity to observe the performance of public officials and to monitor the decisions that are made by such officials in formulating and executing public policy; and further, it is vital that citizens have easy access to public records in order that the society remain free and democratic." (Act 29 Del. C. 10001)
