In the state of Pennsylvania, public records will be subject to a new open records law effective January 1, 2009 that will expand public access to government records greatly when the state's new Office of Open Records begins working. The new law signed on February 14, 2008, states that all records kept by the government are public records in Pennsylvania except in the case of certain exceptions. Additionally, it puts the burden of proof as to why a record cannot be released upon the government agencies instead of on the individuals requesting access to said records.
Known as the Right To Know Law, this legislation will allow individuals to access previously inaccessible public records in Pennsylvania as well as give them a way to petition the court should reasonable access to Pennsylvania public records be refused. As this is a newly created department, the full rules and regulations are currently being drafted and are not yet available.
